United Bags, Inc., including its affiliate sites, where applicable, and all business segments therein (“Company”, “us”, “our” or “we”) respects your privacy and is committed to protecting it through our compliance with this policy.

Children Under the Age of 13

Terms of Service

The BAG Store is the online commerce portal for BAG Corp®. BAG Corp® is a wholly owned subsidiary of United Bags, Inc., a closely held, private company incorporated in Missouri. United Bags, Inc., also owns 100% of United Bags, Inc.. Collectively, for purposes of these Terms of Use (Terms), all the above entities are referred to herein as United Bags, Inc. These terms are effective from April 11, 2011.

Agreement to Terms of Use

Please read the following Terms of Use and disclaimers carefully before using the BAG Store located at www.bagcorp.com (the "Site"). By using the site, you agree to these terms of use, conditions and all applicable laws. If you do not agree, do not use this site. United Bags, Inc. reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time. All such changes are binding on you 14 calendar days after they are initially posted on the Site unless you are a new user, in which case they are binding on you immediately. Disclaimers and errors

In the event a United Bags, Inc. product or service is listed at an incorrect price due to typographical error or error in pricing or shipping information received from its suppliers, United Bags, Inc. shall have the right to refuse or cancel any orders placed for product or service listed at the incorrect price. United Bags, Inc. shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, United Bags, Inc. will issue a credit to your credit card account in the amount of the incorrect price plus any additional fees, etc.

Applicable laws

United Bags, Inc.'s failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. United Bags, Inc. may assign its rights and duties under this Agreement to any party at any time without notice to you.

United Bags, Inc. makes no representation that materials in the Site are appropriate or available for use in other locations, and access to them from territories where their content is illegal is prohibited. Those who choose to access this Site from locations outside of Texas do so on their own initiative and are responsible for compliance with applicable local laws. You may not use or export the materials in violation of U.S. export laws and regulations. The internal substantive laws of the State of Texas shall govern any claim relating to the materials.

Force majeure

Severability

Terms Of Purchase

Product Warranty

Our products are warranted to the original purchaser to be free from defects in material and workmanship. United Bags, Inc. will, at its option, either repair or exchange defective product for ninety (90) days from the date of sale. This warranty is only for the initial use of the product, and is exclusive of any other warranties expressed or implied, including, without limitations, obligations with respect to fitness, merchantability, and consequential damages.

Clearance/Sale Merchandise

All sales marked Clearance, Sale or Super Deal or other like terms implying discounts are final and will not be accept for refunds or exchanges.

Taxes

We are required to collect sales tax on deliveries to all states which require us to do so. We do this through our website and have partnered with a software Avalara to help us calculate and pay all required sales taxes. Sales taxes are collected based on the Ship To location and not the location of the purchaser.

Tax Exempt Certificate

If your company or organization is exempt from paying sale tax and has a Tax Exempt Certificate, please call us at 800-331-9200. Our CSR will assist you in setting up your account with a sales tax exemption status. Only after set up is complete can you then complete your order with tax exempt status. The BAG Store does not process sales tax exemptions retroactively. Tax exempt certificates are required for each state in which the purchaser will be shipping to. For example your company is located in Omaha, Nebraska but your products will be shipping to Seattle, Washington. A State of Washington tax exempt certificate will be required to avoid being taxed at their rates.

Order Acceptance Policy

Your receipt of an order confirmation, electronic or otherwise, does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. United Bags, Inc. reserves the right at any time after receipt of your order to accept or decline your order for any reason or to supply less than the quantity you ordered of any item. An order shall not be deemed accepted by United Bags, Inc. it is shipped.

We only accept credit cards from Cardholders with mailing address in the United States of America.

Guarantee

Under the Fair Credit Billing Act, your bank cannot hold you liable for more than $50.00 of fraudulent charges. If your bank does hold you liable for any of this $50.00, United Bags, Inc. will cover the entire liability for you, up to the full $50.00. United Bags, Inc. will cover this liability only if the unauthorized use of your credit card resulted through no fault of your own from purchases made at United Bags, Inc. while using the secure server.


In the event of unauthorized use of your credit card, you must notify your credit card provider in accordance with its reporting rules and procedures.
